This Privacy Policy governs how Alyta Pty Ltd and its related entities ("Alyta", "we" or "us") treats personal information, including how Alyta collects, manages, uses, discloses and keeps secure personal information (including sensitive personal information) of Users and User Associates (as defined in the Alyta Subscription Agreement), visitors of our websites, business partners, service providers and suppliers (“you” or “your”) when providing our websites, platforms, software, programs and services, including specifically the Alyta Management Software and Alyta Services (as defined in the Alyta Subscription Agreement).

Alyta is committed to the protection of personal information. Alyta collects, holds, uses and discloses personal information in accordance with this Privacy Policy and in accordance with the Privacy Act 1988 and Privacy and Data Protection Act 2014. 

This Privacy Policy may change from time to time and continued engagement with our websites, platforms, software, programs and services indicates acceptance and consent to any revised version of our Privacy Policy, a current copy of which can be found on our website www.alyta.com

  1. Types of information 

1.1 Personal Information

Personal information is any information from which you may be identified or identifiable, directly or indirectly. Personal information we collect and hold may include (without limitation):

  1. Account information including name, username, date of birth, online identifier or identification number and details regarding gender, sex, profile photo, and login credentials;
  2. Contact information including residential and postal address, telephone number, email address, emergency contact and social media handles;
  3. Billing information including administrator and account owner names, signatures, and billing name and address;
  4. Financial/banking information, including credit card and bank account details;
  5. Location information, including specific location information from your device, IP addresses and information about your internet service provider, computer and device information, and location information you manually input;
  6. Information about your business or which identifies the people who work for or are associated with your business, including information about employees (if provided), their role, occupation and job title; and
  7. Information Alyta is otherwise required or authorised by law to collect.

1.2 Sensitive Information

Personal information also includes sensitive information, which includes information relating to your racial or ethnic origin, political opinions, religious or philosophical beliefs, health and sex life or sexual orientation.

The personal information we collect and manage in connection with our business will vary depending on your dealings with us. 

2.1 Direct Collection

We collect personal information with your consent through our websites, platforms, software, and programs and in connection with the provision of our services when we engage directly with you, including when you:

  1. Access or use our websites, platforms, software, programs and services;
  2. Register for an account, update your account or enter your details;
  3. Voluntarily engage with us in other ways through our websites, platforms, software, and programs;
  4. Utilise software or any other electronic application integrated with our websites, platforms, software, and programs;
  5. Communicate with us via phone, email, text, and other forms of electronic messages, including engaging with us on social media; and
  6. Interact with the third-party partners we work with to offer, provide, and improve our websites, platforms, software, programs and services.

You may choose not to provide personal information, however, if we do not collect personal information, we may not be able to provide you with our services.

We automatically collect information to improve our business and services when you browse our websites or use our platforms, software or program. This information includes how you use our websites, platforms, software, programs and any third party websites, platforms, software or programs), the type of device and operating system you use, location information, and marketing and cookie preferences. 

2.3 Collection from Third Parties

Alyta may also receive personal information from third parties (such as business partners, service providers and suppliers) who have agreed to share their customer or marketing lists with us.

2.4 Collection of Sensitive Information

We will only collect sensitive information with your consent when providing our services to you through our websites, platforms, software and programs.

We collect and manage personal information (including sensitive information) as necessary to achieve a legitimate business interest/purpose and enable the operation of our websites, platforms, software and programs and provision of services, including but not limited to: 

  1. confirming your identity and accuracy of information provided to us;
  2. confirming you authority to act on an account;
  3. fulfilling our contract, or taking steps linked to our contractual obligations;
  4. sending service, technical and other administrative messages;
  5. sending notices, investigating complaints, potential breaches, unlawful activity or legal claims and resolving disputes or claims;
  6. processing payments and storing payment history;
  7. managing our technologies and ensuring our websites, platforms, software, and programs are working as intended, and tracking outages or troubleshooting issues;
  8. minimising risks and helping detect, prevent and remedy fraud and other illegal activities;
  9. enabling access to our website and program and providing our services, including any ancillary or third party services; and/or 
  10. enabling us to contact you in the course of providing our websites, platforms, software, programs and services.

4.1 Legitimate Business Purpose/Interest

Alyta may collect, use and disclose personal information for the legitimate business purposes/interests specified above and any other purpose with your consent. We will not use personal information for any unrelated purpose, to any party/individual outside our corporate group, which includes our subsidiaries, our ultimate holding company and its subsidiaries, and our affiliates, without providing notice.

4.2 Third Parties

Alyta may be required to share information with third parties whom we partner with to provide our services (including without limitation payment service providers and electronic applications integrated with our websites, platforms, software and programs to enable operation of the services, our business and provision of services). 

Third parties may use personal information to, among other things, provide marketing communications and targeted advertising to you. Alyta has no control over the privacy practices of third parties and make no representations or warranties in relation to the privacy practices of any third-party. We encourage you to read any privacy policies they may have before providing information to or through any third party.

4.2 Marketing

Alyta may send promotional emails and other targeted marketing communication to you on an ongoing basis to advertise our websites, platforms, software, programs and services unless or until you elect to opt out at any time by providing us notice in writing that you wish to be removed from our marketing/mailing list. 

You can do this by following the instructions in the communications we send to you, or by contacting us. We will still send you important notices relating to your account, operational activities, and technical updates, even after you have opted out of receiving direct marketing communications.

To enable us to deliver relevant and targeted content, we uses cookies (information stored on your computer by websites which may relate to browsing habits, or a unique identification number) and other data tracking technologies to collect anonymous data about website visitors. You may turn off cookies or customise settings for cookies using the ‘Help’ menu on you browser, however we note this may affect some features on our website.

4.3 As compelled by law

We may also be required to disclose personal information to comply with any court order, law, or other legal process, including to respond to any government or regulatory request, enforce or apply any agreements between Alyta and you, protect and defend our rights, and to complete a sale, transfer or merger of our business (including in contemplation of such transactions).

5.1 Access to Information

You (or your authorised legal representative) may request access to your personal information held by Alyta in writing at any time. Such a request must describe the request for information in sufficient detail to allow us to properly understand, evaluate and respond. We may also require you to provide proof of identification and/or authority to allow us to reasonably verify you are the person about whom the personal information relates. 

We will respond within a reasonable time to a request for access and provide access to the information, except in circumstances where refusing access is permitted or authorised by law. If we refuse to provide access to personal information, we will inform you of the reason when responding to your request, for example, if fulfilling your request would reveal personal information about another person.

5.2 Accuracy of Information

Alyta take reasonable steps to ensure personal information collected is accurate, complete, relevant and up to date. You must immediately contact us if you believe any of your personal information requires correction. We will take reasonable steps to correct any errors and notify any relevant third parties. 

If we refuse to correct personal information, we will provide reasons for such refusal.

  1. Protection and Security 

Alyta are committed to upholding the confidentiality, privacy and protection of personal information and take reasonable steps to protect personal information we collect from misuse, interference, loss, unauthorised access, modification or disclosure, including but not limited to authentication and access controls, encryption, records management protocols and secure premises. 

Personal information is stored in both physical and electronic form, sometimes with the assistance of third parties, and access is restricted to individuals with a specific need to access the information to provide services, or otherwise for the purposes described in this Privacy Policy.

No method of transmission over the internet or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of personal information we manage.

You must maintain the confidentiality of any password and accounts used on our websites, platforms, software and programs and notify us immediately if there is any unauthorised use of your account or any other breach of security relating to your account.

We store personal information for as long as your subscription or agreement continues or for as long as it is necessary to deliver our services 

We store usage information and analytics data relating to your use of our websites, platforms, software, program and services through the use of cookies and tracking technologies to provide us with user analytics data to improve our services and enhance your experience. 

You may contact us at any time to request we delete some of your personal information. Where your personal information has been provided to us by a third party, you must ask that third party to correct or delete your personal information on your behalf. 

We may be required at law to retain certain information, for specific purposes and for an extended period of time, including for security, fraud prevention, financial record-keeping or other legal or regulatory purposes.

If you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping, we will inform you of the reason for retaining the information when responding to your request.

If a complaint arises about our use or disclosure of personal information, you may contact us in writing detailing the complaint and we will endeavour to address and resolve the complaint. 

Once we receive a complaint, we will commence an investigation as soon as practicable and may contact you to seek clarification if necessary. We may also contact you to inform you of the outcome of the investigation and detail any action (if deemed appropriate and required in the circumstances) we propose to take in relation to the complaint. 

We will aim to ensure that all questions and concerns are resolved in a timely and appropriate manner. If you are not satisfied with the outcome of your complaint, or require further information on privacy, you may contact the Office of the Australian Information Commissioner.
